Terms of Service
Welcome to Arcvita. These Terms of Service ("Terms") govern your access to and use of the Arcvita mobile application, website (arcvita.health), and related services (collectively, the "Service") provided by Arcvita ("Arcvita," "we," "us," or "our").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
1.1 What Arcvita Does
Arcvita is a personal health intelligence platform that helps you organize, understand, and track your health data. The Service may include:
- Importing and normalizing biomarker data from lab reports
- Connecting to wearable devices (Whoop, Oura, Apple HealthKit) to collect health metrics
- Computing a composite wellness score (the "Arcvita Score")
- Providing AI-powered health coaching and insights
- Tracking trends in your biomarkers and health data over time
1.2 What Arcvita Is Not
Arcvita is not a medical device, medical service, or healthcare provider.
The Service provides general wellness information and health data organization. It does not provide medical advice, diagnoses, treatment recommendations, or prescriptions. The Arcvita Score, AI coaching, biomarker insights, and any other outputs of the Service are for informational and educational purposes only.
Always consult a qualified healthcare professional for medical advice, diagnosis, or treatment. Do not disregard professional medical advice or delay seeking it because of information provided by Arcvita. If you are experiencing a medical emergency, call your local emergency services immediately.
2. Accounts
2.1 Account Creation
To use the Service, you must create an account using Sign in with Apple. You must be at least 13 years old to create an account. By creating an account, you represent that you meet this age requirement.
2.2 Account Security
You are responsible for maintaining the security of your Apple ID and any device used to access the Service. You agree to notify us immediately if you become aware of any unauthorized access to your account.
2.3 Account Termination
You may delete your account at any time through the app (Profile → Privacy & Data → Delete All Data) or by contacting us at privacy@arcvita.health. Upon deletion, your data will be removed in accordance with our Privacy Policy.
We may suspend or terminate your account if you violate these Terms, use the Service in a manner that could harm other users or the Service, or as required by law.
3. Your Health Data
3.1 Ownership
Your health data belongs to you. Arcvita does not claim ownership of any health data, lab results, biomarker values, or other personal information you provide or generate through the Service.
3.2 License to Provide the Service
By using the Service, you grant Arcvita a limited, non-exclusive license to process your health data solely for the purpose of providing, maintaining, and improving the Service. This license ends when you delete your data or your account.
3.3 Data Accuracy
You are responsible for the accuracy of the health data you provide. Arcvita uses AI to parse lab reports and may not always extract values perfectly. You should review imported data for accuracy, particularly before making health decisions based on it.
3.4 Data Portability
You may export your data at any time through the app (Profile → Privacy & Data → Export Data). Your data is provided in JSON format.
4. AI Health Coaching
4.1 Nature of AI Coaching
Arcvita's AI health coaching feature uses third-party artificial intelligence technology to analyze your health data and provide conversational insights. AI coaching is not a substitute for professional medical advice.
4.2 Consent
Before using AI coaching for the first time, you will be presented with a disclosure explaining what data is shared with our AI processing infrastructure. You must accept this disclosure to use the AI coaching feature. You may decline and still use all other features of the Service.
4.3 Limitations
AI-generated responses may contain inaccuracies. Arcvita does not guarantee the accuracy, completeness, or usefulness of any AI coaching output. You should independently verify any health information before acting on it.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Upload data that you do not have the right to share
- Attempt to gain unauthorized access to the Service or its infrastructure
- Interfere with or disrupt the Service or its servers
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to harm, harass, or impersonate another person
- Circumvent any rate limiting, access controls, or security measures
- Use automated means (bots, scrapers) to access the Service without our written permission
6. Intellectual Property
6.1 Our Property
The Service, including its design, features, code, algorithms, branding, and documentation, is owned by Arcvita and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without our written consent.
6.2 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, perpetual license to use that feedback to improve the Service. You are under no obligation to provide feedback.
7. Third-Party Services
The Service integrates with third-party platforms including Apple HealthKit, Whoop, Oura, and Anthropic (AI coaching). Your use of these integrations is also subject to the respective third-party terms and privacy policies. Arcvita is not responsible for the availability, accuracy, or conduct of third-party services.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Arcvita does not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- Lab report parsing, biomarker normalization, or AI coaching will be accurate or complete
- The Arcvita Score or any health insights reflect your actual health status
- The Service will meet your specific requirements
9. Limitation of Liability
To the maximum extent permitted by applicable law, Arcvita and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, health outcomes, or goodwill, arising from or related to your use of the Service.
In no event shall Arcvita's total liability to you for all claims arising from or related to the Service exceed the amount you paid Arcvita in the twelve (12) months preceding the event giving rise to the claim, or fifty dollars ($50), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Arcvita and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any health data you provide through the Service
11. Beta Services
The Service may include features designated as "beta" or "early access." Beta features are provided for testing purposes and may be incomplete, contain bugs, or be discontinued without notice. Your use of beta features is at your own risk and subject to any additional terms we may provide.
12. Changes to the Service
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of material changes that affect your use of the Service.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by other means before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, except that either party may seek injunctive relief in any court of competent jurisdiction.
Class action waiver: You agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated, or representative action.
15. General
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Arcvita regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment: You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
